Woman who kidnapped children in child custody dispute arrested

Parents throughout Texas who are no longer together and are in the midst of a child custody dispute need to understand that the well-being of the children must come to the forefront. With a disagreement as to living arrangements, when the children will spend time with each parent, which parent will be granted custody and numerous other issues, there might be the temptation on the part of one of the parents to take matters into his or her own hands and take the children elsewhere. This can lead to criminal charges and long-term problems.

A 30-year-old Texas woman is facing criminal charges after being indicted for kidnapping her children after custody had been given to the father. The woman was caught in Oregon with the two young children. The mother and father divorced in July 2014 and the father was given full custody. Prior to the decree, the mother departed Texas without telling the father where she was going. The father had been working with law enforcement to get the children back since she absconded. The U.S. Marshals began an investigation after the start of the new year.

The woman was found in Oregon and arrested. The children were found at an elementary school and taken to the children’s services department in Oregon. Texas and Oregon are working to have the children brought back to Texas and their father. The mother has been charged with two counts of aggravated kidnapping and interference with custody. Extradition to Texas is pending.

In spite of the emotions accompanying a child custody battle, parents need to adhere to the law. Unfortunately, in some instances like this particular case, a parent will surrender to baser instincts and make the mistake of leaving the state with the children without having an approval to do so. When there is a problem with enforcing a child custody order, the custodial and noncustodial parents need to know that they have legal options. Speaking to an attorney can help with maintaining a relationship with children and handling a child custody dispute.
